TITLE IX NOTICE TO THE PUBLIC

The Edgefield County School District is required by federal and state laws not to discriminate on the basis of race, religion, color, disability, sex (including pregnancy, childbirth, or any related medical condition), age, alienage, national origin, immigrant status or English-speaking status, or marital status.  The District, therefore, commits itself to nondiscrimination in all its education activities, including admission and employment. 

Title IX is a gender equity law prohibiting discrimination based on gender in education programs.  Sexual harassment, which includes sexual violence and other forms of nonconsensual sexual misconduct, is a form of sex discrimination prohibited under this law.  Specifically, the law states “No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.”

Specific to Title IX, the District does not discriminate on the basis of sex in its education programs or activities.  Gender-based harassment is prohibited, which may include verbal, nonverbal, or physical aggression, intimidation, or hostility based on sex even if those acts do not involve conduct of a sexual nature. The District along with the Title IX Coordinator works to comply with both the letter and spirit of the law in making sure discrimination does not exist in its policies, regulations, and operations. Board policies GBAB and JBAB outline the District’s compliance with the regulation. The District works to ensure a safe, welcoming environment free of sexual harassment and will not tolerate sexual harassment activity by any District employee, substitute employee, student or third party.  The District will act quickly and impartially to address all claims of sexual harassment and discrimination. 

Under Title IX, discrimination on the basis of sex can include sexual harassment, which is defined as conduct on the basis of sex that satisfies one or more of the following:

An employee of the District conditioning the provision of an aid, benefit, or service of the District on participation in unwelcome conduct;
Unwelcome conduct that a reasonable person would determine to be so severe, pervasive, and objectively offensive that it effectively denies a person equal access to the District’s education program or activity;
Sexual assault, dating violence, domestic violence, or stalking, as defined by applicable law.

The Title IX Coordinator will act with independence, free from conflicts of interest and bias.  To raise any concern involving bias or conflicts of interest by the Title IX Coordinator, please contact Dr. Kevin O’Gorman, Superintendent.

District Response

After a report of sexual harassment has been made, the Title IX coordinator will reach out to the individual affected by the alleged misconduct, provide supportive measures, discuss the grievance policy, and offer the opportunity for the complainant to file a formal complaint if the behavior meets the Title IX definition of sexual harassment.  If a formal complaint is filed, appropriate steps will be taken to investigate.
